Allocation of waste producer number

The waste generator number is an identification number necessary to comply with the provisions of §§ 50, 51 Circular Economy Act (KrWG) as well as the Verification Ordinance (NachwV).

Commercial waste generators generating more than a total of two tons of hazardous waste annually are subject to the verification obligation and may require a waste generator number. In this regard, you should consult with your disposal company.

Commercial waste generation occurs when the generation is for the purpose of generating revenue.

The application for a waste generator number can be submitted in written or electronic form.

Participation in the electronic verification procedure:

Commercial waste generators and waste holders are required to provide proof of waste disposal in electronic form. According to § 2 paragraph 2 NachV, waste generators are exempt from the verification obligation if no more than a total of two tons of hazardous waste (small quantities) are generated annually. If less than 20 tons of a waste code are generated per site and calendar year, the waste generator can participate in a collective disposal. This exemption rule also applies to the collective disposal procedure.

The electronic verifications must be provided with a qualified electronic signature in accordance with the Signature Act (SigG).

To use a qualified electronic signature, the following prerequisites must be met:

• availability of a qualified certificate (signature card)
• a chip card reader
• appropriate software.

The Federal Network Agency is the competent authority under the SigG. The signature card is personal.

Procedural Authorizations:

The waste generator can only authorize a representative by submitting the Declaration of Responsibility. For this purpose, both the waste generator and the authorized representative are indicated in the form cover sheet for disposal verifications (DEN).

Only one authorized representative can be appointed for each disposal verification. The general waste-related obligations remain with the waste generator despite the authorization.

The authorization must be made in writing.

The authorization can only be extended in special case constellations. This is the case if the authorized representative is involved in the actual control of the waste subject to verification obligations.

For collective disposal verifications, such authorization is not possible.
