Facilities that do not require approval

Non-approval-requiring facilities within the meaning of the Federal Immission Control Act (BImSchG) are stationary or mobile facilities that fall under the 4th Ordinance to the BImSchG - Ordinance on approval-requiring facilities - but do not meet the sizes and performance values listed there.

The classification of a facility within the scope of the BImSchG depends on the environmental impacts expected from the facility, such as noise, air pollution, vibrations, light emissions, and electromagnetic fields.

In the Oberbergischer Kreis, there are several thousand facilities such as gas stations, car workshops, retail businesses, construction and finishing trades, agricultural businesses, mobile phone stations, wind turbines, etc., that must be monitored for immissions control.

The approval and operation of commercial facilities that do not require approval under the BImSchG usually take place within a building permit procedure. The immissions control authority of the Oberbergischer Kreis is regularly involved in these building permit procedures and provides technical opinions regarding the planning law admissibility of the request considering compatibility with immissions control regulations.
