Approval of Facilities Under the Federal Immission Control Act (BImSchG)

The establishment and operation of facilities that, due to their nature or operation, are particularly suitable for causing harmful environmental impacts or otherwise endangering, significantly disadvantaging, or significantly disturbing the public or the neighborhood require approval under the provisions of the Federal Immission Control Act (BImSchG).

Which facilities are subject to approval (depending on the type and size of the facility and the achievement of certain performance values) can be found in the 4th Ordinance to the BImSchG - Ordinance on facilities requiring approval.

The approval procedures are carried out in accordance with the provisions of the Ordinance on the Approval Procedure - 9th BImSchV.
